Sarawak Government VS Wong Soon Koh.

24 June 2021: 22 June,PETRONAS CHAIRMAN TO Testify In SUIT BY STATE GOVERNMENT AGAINST WONG SOON KOH.COURT OF APPEAL AFFIRMS HIGH COURT DECISION.

This morning, the Court of Appeal dismissed an appeal by the PETRONAS Chairman, Tan Sri Ahmad Nizam to set aside a subpoena served upon him to testify as a witness in the defamation suit brought by the Sarawak Government against the leader of the state opposition, Parti Sarawak Bersatu President YB Dato Sri Wong Soon Koh.

Wong was sued by the Sarawak government in respect of a press statement issued by him on 08.03.2018 regarding the settlement between Sarawak State Government and PETRONAS which led to the payment of RM2.89 billion for 2019 Sales Tax.

In the Sibu High Court suit, the Sarawak State Government claimed that the press statement by Wong was defamatory.

Wong had issued a subpoena to compel Nizam to testify as a witness in the trial.

On 12.03.2021 and 05.04.2021, the Sarawak State Government and Nizam Salleh had filed separate applications in the Sibu High Court to set aside the subpoena.

Both applications were heard and dismissed by the Sibu High Court on 13.04.2021.

Nizam appealed to the Court of Appeal against the dismissal of his application to set aside the subpoena.

The Sarawak Government did not appeal against the said decision.

Today, the Court of Appeal found that there was no merit in Nizam’s appeal and dismissed it with costs.

Trial is scheduled to commence in the Sibu High Court on 26.07.2021.
